JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 27.08.2014 in a case registered for the offence punishable under Section 366A/34 of the Indian Penal Code.

The present case was lodged on 26.06.2014 against the petitioner and his father. After institution of the present case, the house of the petitioner was raided on the same day and the petitioner was found absent from his house and the victim was also not recovered from his house. Subsequently, on 30.06.2014, the investigating officer got an information in respect of the victim and thereafter, he came in the village of the victim and saw that the victim was going along with a boy and the aforesaid boy

Patna High Court Cr.Misc. No.7977 of 2015 (3) dt.21-05-2015 having seen the police officials fled away from there and victim was recovered.

No doubt, the victim stated against the petitioner but the above stated circumstances tell a different story. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Munger in connection with Sessions Trial No. 899 of 2014 arising out of Muffasil P.S. Case No. 122 of 2014.
