The petitioner is languishing in custody since 01.01.2015 in a case registered for the offences punishable under Section 364 of the Indian Penal Code.

The brother of the informant went missing on 23.01.2014 when it was suspected that who has been killed. Subsequently during investigation the family members of the informant deposed in paragraphs 53 and 54 of the case diary that the petitioner along with others were seen in the company of the victim just before the occurrence. Some of the witnesses in para 66, 67 and 68 of the case-diary suggested that the victim was in the company of this petitioner and other accused persons

Patna High Court Cr.Misc. No.14551 of 2015 (02) dt.28-04-2015 2/2 and was forcibly made to sit in a vehicle, but such statements were recorded after about a month of the registration of the FIR. The informant neither in first information report nor in the subsequent statement suggested all these facts.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S.
