JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but admittedly, he was not caught on the spot and the apprehended accused persons disclosed that petitioner fled away with stolen bag. It appears that subsequently, the stolen bag is said to have been recovered from the house of the petitioner. Petitioner does not have any criminal antecedent and is languishing in jail custody since 19.08.2015. Moreover, co-accused, Santosh Kumar @ Santosh Kumar Ram, who was caught on the spot, has already been granted privilege of bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.2025 of 2016 (2) dt.22-01-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Madhubani in connection with Jay Nagar P.S. Case No. 203 of 2015.
