JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-08-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Mahua P.S. Case No. 195 of 2020, registered for the offences punishable under Sections 147, 148, 149, 323, 324, 354 (B), 325, 379, 506 of the Indian Penal Code.

As per allegation, the accused persons came to the land of the informant and were storing chaff on the land of the informant. When she protested, the petitioner Ramesh Singh, co-accused Sushant Kumar @ Golu assaulted her and outraged her modesty.

Patna High Court CR. MISC. No.2452 of 2022(2) dt.05-08-2022 2/2 When her husband came to rescue her they also assaulted him and snatched a gold chain worth Rs. 80,000/- from her neck. Learned counsel for the petitioners has submitted that the petitioners are the persons of clean antecedent. There is land dispute between both the parties. As a matter of fact, the land where accused persons were storing chaff was belonging to the petitioners and not to the informant's side. He has also submitted that the injuries sustained by the informant and her husband are simple in nature. Considering the above-mentioned facts and circumstances, especially the clean antecedent of the petitioners, let them, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs.

10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Vaishali at Hajipur in connection with Mahua P.S. Case No. 195 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
