Petitioner is named in the first information report but specific allegation of making firing is against other co-accused. So far as the petitioner is concerned, no specific overt-act has been attributed against him.

Learned counsel for the informant submits that petitioner does have criminal antecedent but learned counsel for the petitioner points out that in almost all cases, petitioner has already been acquitted and moreover, son and grand son of the petitioner were killed by the prosecution party for which informant's family member had already been convicted.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on
