The petitioner seeks bail in connection with Kinjar P.S. Case No. 48 of 2021 registered for the offences punishable under Sections 25(1-AA), 26 and 35 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 30.06.2021, charge-sheet has been submitted in the case and is a person with clean antecedent and allegation is of recovery of a mobile from the petitioner, further a loaded carbine was also recovered from the dicky of the Bolero Car in which the accused persons including the petitioner were travelling and cartridges and arms were recovered from other accused persons.

The learned counsel submits that the petitioner is

No.2454 of 2022(2) dt.25-05-2022 2/2 neither owner nor driver of the Bolero Car, he had taken lift and as such was not knowing what was being carried in the car, it is next submitted that as far as recovery from the present petitioner is concerned, that is only of a mobile and he is a person with clean antecedent.

The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 30.06.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kinjar P.S. Case No. 48 of 2021.
