Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 406, 468, 471 and 120(B)/34 of the Indian Penal Code. The F.I.R. relates to an offence of cheating to different persons including the informant on the pretext of providing job in the Railways.

It has been informed that some other co-accused have already been allowed bail by the court below. Submission is that there is no direct material against the petitioner. In such type of allegation, direct allegation may not be available when the allegation is of conspiracy. Hence in my

Patna High Court CR. MISC. No.3452 of 2020(4) dt.29-06-2020 2/2 view this is not a fit case for grant of anticipatory bail. Hence, prayer for bail of the petitioner is refused in connection with Digha P.S. Case No. 388 of 2018.

In the event of surrender of the petitioner, prayer for regular bail shall be considered without being prejudiced by this order.
