The petitioners apprehend their arrest in Minapur P.S. Case No. 326 of 2014, registered for the offences punishable under Sections 376/511 and other Sections of the Indian Penal Code and different Sections of the POSCO Act. The informant made allegation that Bhikhari Sah made an attempt to commit rape with his daughter, but when the informant went to complain the petitioners are alleged to have assaulted the informant and his wife.
It appears that there is no allegation of ill-treating with the daughter of the informant against the petitioners. The petitioners are brothers and mother of Bhikhari Sah against whom
Patna High Court Cr.Misc. No.8138 of 2015 (2) dt.02-03-2015 2/2 there is allegation of making attempt to commit rape with the daughter of the informant.
Considering the facts aforesaid the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, POSCO Act, Muzaffarpur in connection with Minapur P.S. Case No. 326 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
