The petitioner seeks bail in a case under Section 304B of the Indian Penal Code.

The informant, father of deceased, made allegation that the petitioner, being the elder brother-in-law of his daughter, and other family members burnt his daughter and her daughter's nine months old child due to non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that the date of occurrence is 12.07.2014. The informant was informed on the same day. The deceased was brought to N.M.C.H., but she died on 13.07.2014. Inquest report was prepared. The informant did not lodge the case immediately thereafter. The informant got burn injury while preparing food. The petitioner also got burn injury and he was also admitted in the hospital.

Considering the facts aforesaid and the fact that the petitioner is the elder brother-in-law of the deceased, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad (Bihar) in Kasma P.S. Case No. 23 of 2014.
