The petitioner is accused in connection with Budha Colony P.S. Case No. 253 of 2015, registered under Section 395 of the Indian Penal Code.

The allegation of informant Bikash Kumar Pandey is that on 04.10.2015, he along with his friend Radhy Shayam Sharma was returning from Purnea, after appearing in the examination, when he reached near south Mandiri at that time six boys on two bikes came and caught hold the informant and Radhy Shyam Sharma and all the accused persons started assaulting informant and his friend and snatched mobile of the

Patna High Court Cr.Misc. No.1711 of 2016 (3) dt.23-02-2016 2/2 informant and his friend Radhy Shyam Sharma and Rs. 1000/- and fled away. On giving information to the Police by his friend, the Police vehicle came and in course of search, the petitioner was found near the tempo stand at Budha Ghat, who disclosed his name as Golu Kumar and his other associates. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that petitioner was apprehended by the Police mere on suspicion and no incriminating article have been recovered from the possession of the petitioner. The petitioner has no criminal antecedent and he is a resident of adjacent mohalla of south Mandiri. The petitioner is in custody since 05.10.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, J.M. 1st Class, Patna in connection with Budha Colony P.S. Case No. 253 of 2015. (Rajendra Kumar Mishra, J.) manish/- U T
