Mr. Md. Aslam Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 The petitioner apprehends his arrest in connection with Harsidhi P.S.Case No. 125 of 2018 registered under Sections 406 and 420 of the Indian penal Code.
Allegation against the petitioner, who is Manager of the Petrol Pump of the informant, is of embezzlement of money of sale proceed of petrol and diesel to the tune of Rs. 15,67,832/- and Rs. 1,25,000/- of Mobil.
Submission of learned counsel for the petitioner is that its a case of accounting and petitioner has falsely been implicated in this case.
Heard learned APP also and learned counsel appearing on behalf of the informant, who has opposed the prayer of bail on the ground that after enquiry same was found missing and
Patna High Court CR. MISC. No.2840 of 2019(4) dt.07-03-2019 2/2 petitioner has accepted the same and thereafter he has been absconding.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
