2.The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 30 (a) of the Bihar Prohibition & Excise Amendment Act.

3. The learned cousnel for the petitioner submits that the petitioner has antecedent of two cases and the allegation is of recovery of 54.90 liters of foreign liquor from the motorcycle.

4. The learned counsel for the petitioner submits that the petitioner is not the owner of the motorcycle and he came to be implicated by the local people but the name of the local people in the FIR is not disclosed which cast aspersion on the

Patna High Court CR. MISC. No.4977 of 2024(3) dt.15-02-2024 2/2 case of the prosecution when admittedly the petitioner was not present at the place of occurrence nor any recovery was made from his conscious possession.

5. Learned A.P.P opposes the bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs,. 10,000/- ( Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge, Excise No. 1, Gopalganj in connection with Bhore P.S.Case No. 598 of 2023, subject to the conditions laid down under section 438(2) of the Cr. P.C.
