2. This application, for grant of anticipatory bail, arises out of Industrial Area Police Station Case No. 96 of 2024, disclosing offences under Section 103(1)/3(5) of B.N.S., 2023.

As per the F.I.R, on 09.08.2024, at about 12:30 P.M., the informant got the information that his son Ranjeet Rai, who was living in a rented home with co-accused Anita Devi, has brutally been beaten by co-accused Anita Devi with the help of her accomplices i.e. Paramjeet and Vinod Kumar (the petitioner). It has further been alleged that after brutally beating the informant's son, the accused persons took his body to Konhara ghat in order to cremate it. The informant immediately

4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case only because the deceased happen to be the driver of the petitioner's car. There is no material evidence, which has been collected during the course of investigation against the petitioner, in order to connect him with the present offence and the present case has been lodged only on the basis of suspicion. The petitioner is having no concern with the co-accused Anita Devi with whom the deceased was allegedly used to live for the last three years.

On the other hand, learned counsel for the informant vehemently opposes the prayer for bail and submits that the petitioner is specifically named in the F.I.R. and in the post-mortem report various external injuries on the body of the deceased were found. He further submits that in paragraph no. 74 of the case diary, it has come that the petitioner having criminal antecedent in five cases and is threatening the informant to enter into compromise in the present case and there is possibility of flight of the petitioner, which has come in the investigation report.
6. Having regard to the submissions made on behalf

No.1886 of 2025(2) dt.24-02-2025 3/3 of the parties and taking into consideration the nature of allegation and the fact that the petitioner is specifically named in the F.I.R and there is possibility of flight of the petitioner, coupled with the fact that the petitioner is having five criminal antecedents, I am not inclined to grant the petitioner privilege of anticipatory bail.
