====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 22-01-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

Initially a U.D. case was lodged by the son of the deceased on recovery of the dead body. After two months, wife of the deceased lodged the present case raising suspicion against the petitioners.

Submission is that there is no eye witness of the occurrence. Petitioners are in custody since 25.11.2019.

No.2411 of 2020(2) dt.22-01-2020 2/2 Considering the fact that there is no substantial material against the petitioners for their further detention, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Udwantnagar P.S. Case No. 180 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (c) The petitioners shall not leave the country without permission of the trial Court.
