The petitioner seeks anticipatory bail in connection with Rahika P.S.Case No. 89 of 2018, registered for offences punishable under Sections 279, 337, 338, 304 and 304 (A) of the Indian Penal Code.

Allegation as per F.I.R. against the petitioner is that he dashed the motorcycle of the deceased by negligence driving of the truck.

Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the petitioner is the authorized driver of the truck and having valid license, which is annexed as Annexure-2 and the petitioner has no intention in killing the nephew of the informant and the petitioner has no criminal antecedent.

Patna High Court CR. MISC. No.2931 of 2019(3) dt.07-03-2019 2/2 Heard learned A.P.P. who opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, be released on provisional bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Madhubani in connection witb Rahika P.S.Case No. 89 of 2018 corresponding to C.R.I. Case No. 1778 of 2018, subject to the conditions that in the meant time the learned lower Court shall verify the validity of the license of the petitioner and if he satisfied, his bail bond shall be confirmed otherwise he is free to cancel his bail bonds.

Accordingly this application is disposed of.
