JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is languishing in jail since 30.10.2015 in a case registered for the offences punishable under Sections 498A and 379/34 of the IPC. The basic accusation is of torture. It is specifically alleged that a meeting for reconciliation was called for by the family members of the petitioner when co-accused assaulted the informant and the petitioner snatched gold earring causing injury on the ear of the informant.
It is submitted by learned counsel for the petitioner that on conclusion of investigation, chargesheet has been submitted under Section 498A IPC only. The injury has been found to be simple.
Considering the nature of accusation and the fact that
Patna High Court Cr.Misc. No.2265 of 2016 (3) dt.03-02-2016 2/2 investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bagaha, West Champaran in connection with Ramnagar P.S.
