The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence, petitioner assaulted the informant with iron rod causing head injury. Co-accused Saurav Kumar snatched RS. 50,000/- from pocket of the informant and co-accused Sunita Kumari snatched gold chain from his neck. It is submitted that petitioner has been falsely implicated in this case due to land dispute between the parties and both parties are agnates. The doctor has found the injury which is attributed to this petitioner simple in nature. Allegation

Considering the facts aforesaid and nature of injury, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Nawada in connection with Kawakole P.S. Case No. 454 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
