The petitioner apprehends his arrest in Ballia P.S. Case No.403 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The informant got secret information that petitioner had concealed foreign liquor in his house for selling and on such, a raid was conducted. Six bottles each containing 180 ml. liquor were recovered from the house of the petitioner. The learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. Nothing has been recovered from the house of the petitioner. Petitioner was not arrested from his house. Somebody might have kept the liquor in his house.

Taking into consideration the fact that liquor was

Patna High Court CR. MISC. No.1009 of 2020(5) dt.01-07-2020 2/2 recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
