The petitioner seeks bail in a case registered for the offence punishable under Section 302 of IPC.

Allegation against the petitioner is to have killed his wife, deceased.

Learned counsel for the petitioner submits that the deceased was a lady of short temperament. There is no eye witness to the occurrence. The petitioner has no criminal antecedent and he has been in custody since 12.5.2014.

Learned counsel for the State submits that there is specific allegation of overtact against the petitioner. After investigation, charge-sheet has already been submitted and the

Patna High Court Cr.Misc. No.10906 of 2015 (5) dt.26-06-2015 2/2 charge has also been framed against the petitioner and the case is pending for prosecution evidence.

Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail at this stage. His prayer for bail is rejected.

Let the trial be expedited.
