2. The petitioner has prayed for bail in connection with Bypass P.S. Case No. 81 of 2025 registered for the offence punishable under Sections 20 and 22 of the N.D.P.S. Act.
3. The case of the prosecution, in short, is that from the house of the co-accused Md. Hasim, altogether 11 liters of cough syrup and Rs. 24,080/- were recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. His name has surfaced only on the statement of coaccused. Nothing has been recovered from his possession. It has
Patna High Court CR. MISC. No.3988 of 2026(2) dt.06-02-2026 2/2 further been submitted that Md. Hasim has already been granted bail by this Court vide Cr. Misc. No. 58513 of 2025. The case of this petitioner stands on better footing. He is having no criminal antecedent and he is languishing in judicial custody since 18.11.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Principal District and Sessions Judge, Bhagalpur in connection with Bypass P.S. Case No.81 of 2025.
