JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Waris Nagar P.S. Case No. 33 of 2019 registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

According to prosecution case, more than three hundred persons blocked the road in protest of murder of a person and when police party went there to clear blockage, the aforesaid mob became furious and FIR named accused Rajendra Ram assaulted the police officials. The rioters also damaged police jeep.

No.1379 of 2020(2) dt.27-02-2020 2/2 At the very outset, learned counsel appearing for the petitioners submits that above stated Rajendra Ram and some others have already been granted privilege of anticipatory bail by a co-ordinate Bench of this court vide Cr. Misc. No. 86013 of 2019. He further submits that moreover, the entire allegation of assault is against Rajendra Ram.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in Waris Nagar P.S. Case No. 33 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
