The petitioner apprehends his arrest for the offences alleged under Sections 356, 379, 411, 337, 338 and 279/34 of the Indian Penal Code, registered in connection with Kathaiya P.S.Case No. 128 of 2020.
As per the allegation, three persons on a motorcycle were fleeing away after snatching the mobile set of the informant. One of those named Chandan Kumar was apprehended by the mob and he disclosed the name of the present petitioner.
The learned counsel for the petitioner has submitted that the petitioner's name has been figured only in the
Patna High Court CR. MISC. No.11575 of 2021(2) dt.23-12-2021 2/2 confessional statement of the co-accused and the petitioner has no criminal antecedents, as has been disclosed in paragraph no.3 of the bail petition.
Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV (West) Muzaffarpur in connection with Kathaiya P.S.Case No.128 of 2020, subject to the conditions as laid down under Section 438(2) Cr.
