JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 1209-2014 on the accusation that one loaded country-made pistol and one live cartridge were recovered from his conscious possession, when he along with others were assembled to make preparation of committing dacoity.

The petitioner carries criminal antecedent of four cases but having more or less similar allegation, one co-accused, Madan Paswan has already been granted privilege of bail by a coordinate bench of this court.

Taking note of the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.12451 of 2015 (2) dt.27-03-2015 as well as period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dawath P.S. Case No. 100 of 2014 to the satisfaction of Judicial Magistrate-Ist Class, Bikramganj, Rohtas.
