The petitioner apprehends his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and sections 30(a) of the Bihar Prohibition and Excise Act.

60 litres of country made liquor and one motorcycle has been recovered from Highway.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner has got no concern with the seized liquor or the motorcycle. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court

Patna High Court CR. MISC. No.3638 of 2023(2) dt.03-04-2023 2/2 below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 1-cum-Additional Sessions Judge, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 971 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
