JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This application, for grant of anticipatory bail, arises out of Town (Buxar) P.S. Case No. 800 of 2019, disclosing offences under Sections 353, 504, 506/34 of the Indian Penal Code.

Prosecution case is that motorcycle of one Chhitaranjan Singh was seized by the police during vehicle checking and petitioner no. 2 came and misbehaved with the police personnel and also threatened of dire consequences. Submission of learned counsel for the petitioners is that as a matter of fact, there was marriage ceremony in the family of the petitioners and due to which, they went to the police to release the vehicle, for which, petitioners have falsely

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, so far petitioner no. 1 is concerned, in the event of his arrest or surrender before the court below within six weeks, he is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Town (Buxar) P.S. Case No. 800 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

So far petitioner no. 2 is concerned, I am not inclined to grant the privilege of anticipatory bail to him rather he has to surrender in the court below and pray for regular bail, which will be disposed of by the court below on the merit of the case.

This application is accordingly disposed of.
