JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-03-2022 Heard Mr. Sanjay Kumar, learned counsel for the petitioner and Mr. Shailendra Kumar Singh for the State. The petitioner seeks bail in anticipation of his arrest in connection with Hilsa P.S. Case No. 466 of 2020 dated 19.09.2020 instituted for the offences under Sections 341, 323, 504, 385, 307, 379 & 34 of the Indian Penal Code. The petitioner and others are said to have entered the house of the Informant and the petitioner is specifically alleged to have assaulted the Informant on his head by means of an iron rod.

The petitioner has a different story to narrate. In fact, the Informant was keeping a lustful eye on the minor sister of the petitioner for which there had been verbal skirmish between the parties a number of times. It has been

Patna High Court CR. MISC. No.18883 of 2021(2) dt.11-03-2022 2/2 stated that because of that dispute, the aforesaid occurrence might have taken place but, the accusation is overly exaggerated.

A complaint also appears to have been lodged by the mother of the petitioner against the Informant of the present case which was the basis for registration of Hilsa P.S. Case No. 481 of 2020.

The injuries suffered by the Informant is stated to be simple in nature.

Regard being had to the aforesaid fact, the petitioner directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa (Nalanda) in connection with Hilsa P.S. Case No. 466 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
