The petitioner is accused in connection with Kudra P.S. Case No.243/2015 registered under Sections 302, 201/34 of the Indian Penal Code and under Section 27 of the Arms Act. The accusation is that Najare Alam, the brother-in-law of the informant came to the house of informant along with his sister namely Soni Bano and thereafter informant boarded the deceased on a bus for the destination of Banaras but his dead body was found in the next day near village Salthua Siwan. Learned counsel for the petitioner submits that the petitioner is not named in F.I.R. In course of investigation, Sultana Bano, mother of informant Shamser Ahmed disclosed that there

No.1579 of 2016 (3) dt.23-02-2016 was love affair between the petitioner and younger sister of informant namely Soni Bano and due to that reason, her son-inlaw Najare Alam made complaint to this petitioner, so there is probability of hand of this petitioner in the murder of deceased Najare Alam. It is further submitted that except suspicion, there is nothing against the petitioner. The further submission is that the petitioner is accused in Durgawati P.S. Case No.145 of 2011 for the offence under E.C.Act, in which petitioner is on bail and in the present case the petitioner is in custody since 14.11.2015. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Kudra P.S. Case No. 243/2015 corresponding to G.R. No.2028/2015.
