JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Kudhani P.S. Case No. 258 of 2018 for the offence under Sections 414/34 of the Indian Penal Code and Section 30(a), 38(i), 41(i) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case it is alleged that total 1709 liters liquor was seized. The learned counsel submits that from the seizure list it is not clear from where the liquor was seized and how the petitioner is connected with the business of liquor. Learned counsel submits that the petitioner has got no concern with the alleged recovery of liquor or the pick-up van or the Honda Twister motorcycle or the two mobile set in connection with the same case.

No.40530 of 2018(2) dt.10-07-2018 2/2 Considering the fact that the petitioner has no criminal antecedent and he is in custody since 03.06.2018, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Kudhani P.S. Case No. 258 of 2018.
