The petitioner seeks anticipatory bail in connection with Bhagwanpur P.S.Case No. 156 of 2018, registered for offences punishable under Sections 307, 504, 120 (B)/34 of the Indian Penal Code and 27 of the Arms Act.

As per F.I.R., allegation against the petitioner is that the petitioner along with other accused persons entered into the house of the informant and started abusing and co-accused Hanuman Pandey opened fire twice, which hit on the chest of the informant, due to which he seriously injured. Submission of the learned counsel for the informant submits that F.I.R. itself shows about the specific attribution against one Hanuman Pandey not against the petitioner and he has no criminal antecedent.

Patna High Court CR. MISC. No.4407 of 2019(3) dt.11-03-2019 2/2 Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Bhagwanpur P.S.Case No. 156 of 2018, to the satisfaction of learned Additional Chief Judicial Magistrate, 5th Bhabhua , subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
