The petitioner is languishing in custody since 22.09.2014 in a case registered for the offences punishable under Sections 363, 366A and 120B/34 of the Indian Penal Code. The prosecution case is that the daughter of the informant Pratima Kumari and niece Mina Kumari went traceless while they went to attend coaching classes. On search the informant came to know that the victims were kidnapped for the purposes of marriage. Though, in 164 Cr.P.C. statement the victim has alleged that she was being kidnapped by petitioner, Manohar Ram, Meghu Ram, Ramesh Ram, Chhathu Ram and Nitesh Ram,

No.15421 of 2015 (02) dt.22-06-2015 2/2 but the petitioner and others returned from Motihari railway station and thereafter she went to Hisar in the company of Ramesh, Meghu and Manohar. Thereafter, the victim returned along with three persons in whose company the victim travelled to Hisar when the uncle of the victim went to Hisar. Considering the conduct of the victim, co-accused Ramesh Ram has been granted bail vide Cr. Misc. No. 565 of 2015.
It is submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent and since the son of the petitioner was involved in the offence, hence, he has been roped in, who is aged person.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, East Champaran, Motihari in connection with POCSO Trial No. 25 of 2014 arising out of Pakaridayal P.S.
