JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-03-2021 As prayed for, let the learned counsel appearing on behalf of the petitioner remove the defect(s), as pointed out by the office vide its notes dated 11.01.2021, within four weeks of starting of the Court proceeding in physical mode. Heard learned counsel appearing for the petitioner and the learned A.P.P. appearing for the State.

This application has been filed on behalf of the petitioner for modification of the order dated 02.03.2020 passed in Criminal Misc. No.5035 of 2020 by a Bench of this Court with regard to extension of period of surrender of the petitioner in connection with Supaul P.S. Case No.652 of 2019, pending in the court of the learned Judicial Magistrate, First Class, Supaul.

Patna High Court CR. MISC. No.3628 of 2021(2) dt.02-03-2021 2/3 It appears that vide order dated 02.03.2020 passed in Criminal Misc. No.5035 of 2020 by a Bench of this Court, the petitioner, in the event of her arrest/surrender within four weeks from the date of receipt of the aforesaid order to the court concerned, was directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Supaul, in connection with Supaul P.S. Case No.652 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C., but, for the reasons, mentioned in this application, the petitioner could not surrender before the court concerned within the stipulated period. In that view of the matter, learned counsel for the petitioner prays for modification of the order dated 02.03.2020 passed in Criminal Misc. No.5035 of 2020 by a Bench of this Court in this regard.

Let the period of surrender of the petitioner in connection with the aforesaid case before the court concerned be extended for a further period of four weeks from today. The order dated 02.03.2020 passed in Criminal Misc. No.5035 of 2020 by a Bench of this Court is modified to the aforesaid extent only.
