The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 411/34 of the Indian Penal Code.
As per the prosecution case, the informant got secret information that in front of shop of one Shambhu Chaudhary in Garage (Kabarikhana) situated at Dabhaich the stolen truck was being cut. On this information, informant along with police force reached at the place. On seeing the police party, 4-5 persons started fleeing, out of whom one person was apprehended who disclosed his name as Santosh Kumar and he disclosed that the said Kabarikhana is of his uncle (petitioner). Patna High Court CR. MISC. No.2454 of 2023(2) dt.28-03-2023 2/2 implicated in this case. On the basis of confessional statement of co-accused, petitioner has been made accused in this case. No stolen or incriminating article has been recovered from possession of this petitioner. Petitioner is not the owner of the said Kabarikhana. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 112 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
