JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This application, for grant of anticipatory bail, arises out of Dinara P.S. Case No.133 of 2019, disclosing offences under Sections 363, 366(A) and 34 of the Indian Penal Code.

Petitioner is named in the F.I.R and allegation is of kidnapping the minor daughter of the informant. Submission of learned counsel for the petitioner is that as a matter of fact victim girl has love affair with the brother of the petitioner and she eloped with him and married with him and the victim girl has stated so in her statement recorded under Section 164 Cr.P.C.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with

Patna High Court CR. MISC. No.694 of 2020(2) dt.23-01-2020 2/2 direction to the court below to verify the submission of learned counsel for the petitioner with regard to the statement of girl recorded under Section 164 Cr.P.C. and if the same is found true, on surrender, he will release the petitioner on bail to his own satisfaction.
