The petitioner being the husband of the victim is languishing in custody since 08.06.2014 in a case registered for the offences punishable under Sections 304B, 323 and 120B of the Indian Penal Code.

The accusation is of killing the daughter of the informant after six years and ten months of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the independent witnesses have suggested that the victim committed suicide when the petitioner was not present in the house. The door of the room was broke open by the co-

It is submitted by learned counsel for the State that some of the witnesses from the informant side have suggested that the victim was killed, though, none of the independent witnesses have suggested that the victim committed suicide but there has been demand of dowry form before. Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner at present in connection with Lauriya P.S. Case No. 64 of 2014 pending in the court of Additional Chief Judicial Magistrate, West Champaran at Bettiah.

Accordingly, the prayer for bail of the petitioner is rejected.

Let the trial be expedited.

However, the petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within a period of one year.
