The petitioner is apprehending his arrest in connection with Kalyanpur P.S.Case No.98 of 2018 , registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 192.75 ltrs. of liquor from the field and the accused persons succeeded in fleeing away and they have been identified including the petitioner.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession or from his house as well as he has no criminal antecedent and the other accused persons have been granted privilege of the anticipatory

Patna High Court Cr.Misc. No.2662 of 2019(3) dt.21-02-2019 2/2 bail, vide order dated 27.9.2018 passed in Cr. Misc. No.51961 of 2018.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-3-cum-Special Judge Excise, Samastipur in connection with Kalyanpur P.S.case No.98 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
