JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Complaint Case No. 565 of 2018 disclosing offences under Section 498A of IPC and Section 4 of Dowry Prohibition Act.
As per F.I.R. petitioner, who happens to be the husband of the complainant. There is allegation of demand of Rs.5 lakhs and also causing assault her for that. Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is still ready to keep her with dignity and care, that stand had also been taken before the learned Sessions Judge. Further submission is that the mother of the petitioner has also approached the Mahila
Patna High Court CR. MISC. No.2120 of 2020(2) dt.16-01-2020 2/2 Helpline for that, but the opposite party no.2 is not ready to reside with the petitioner.
Heard learned A.P.P. as well as learned counsel for the opposite party no.2/complainant, who has drawn my attention towards the impugned order, it has been submitted that she was kept confined and kept under vigilance of CCTV. As such, it is not possible her to reside with the petitioner. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Gaya, in connection with Complaint Case No. 565 of 2018.
