The petitioner being the husband of the victim is languishing in custody since 03.08.2015 in Nokha P.S. Case No.124/2015 registered for the offences punishable under sections 498A, 304B, 201, 34 of the Indian Penal Code, pending before the learned SDJM, Sasaram (Rohtas).

Accusation is of killing the sister of the informant after six years of marriage.

It is submitted by learned counsel for the petitioner that in fact the victim died due to accidental burn injuries after 7 years of marriage.

Considering the thrust of accusation against the petitioner being husband of the victim, this court is not inclined to

Patna High Court Cr.Misc. No.1738 of 2016 (4) dt.22-02-2016 2/2 grant bail to the petitioner at present. Accordingly, the application for bail on behalf of the petitioner is rejected. However, if the trial will not be concluded within a period of one year, the petitioner would be at liberty to renew the prayer for bail.
