Petitioner is seeking anticipatory bail in connection with Wazirganj P.S. Case No.301 of 2017 dated 13.07.2017 registered for the offences punishable under Sections 467, 468 and 420 of the Indian Penal Code and Section 7 of the Essential Commodities Act, 1955.

Learned counsel for the petitioner submits that the petitioner is a licensee of a Public Distribution Shop against whom one F.I.R. has been lodged without there being any inquiry on the basis of the allegations made by some of the consumers. Learned counsel submits that the entire allegations are false and concocted as no material has been recovered in support of the allegations. Learned counsel for the petitioner further submits that the petitioner has otherwise no other

Learned APP for the State is not present.

Considering the nature of allegations, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/-(rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st,Gaya in connection with Wazirganj P.S. Case No. 301 of 2017, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of his bail bond. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
