Learned counsel appearing for the State submits that it is clearly stated in the counter affidavit filed on behalf of the respondent nos.2 and 3 that after due consideration of the matter payment of admitted salary for the period explained therein has already been sanctioned and his period of absence as described in the aforesaid paragraph has also been regularized as extraordinary leave as per Rule 180 of the Bihar Service Code vide order no.228
Patna High Court CWJC No.12448 of 2008 (4) dt.05-11-2015 2 / 2 dated 17.09.2015 and the Registrar, Co-operative Society Department has been requested to make payment of due salary to the petitioner. It is contended that, subsequently, the said amount has already been credited to the account of the petitioner. Be that as it may, since none has appeared on behalf of the petitioner, this writ application is dismissed for want of prosecution.
