The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366, 314, 304 of the Indian Penal Code. The prosecution case as per F.I.R is that the informant lived in Harnaut to earn his livelihood. It is alleged that on 02.01.2020, this petitioner enticed away the wife of the informant. Later on, the informant came to know that his wife is lying dead in Jivan Jyoti Hospital, Biharsharif. It is further alleged that petitioner

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case and only on suspicion, the petitioner has been roped in the present case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned A.P.P appearing on behalf of the State on perusal of the case diary as well as F.I.R and the impugned order has vehemently opposed the prayer for anticipatory bail of the petitioner. It is further submitted that the witnesses during investigation have supported the prosecution version. There is also circumstantial evidence against the petitioner. The F.S.L report suggests that poisonous substances were detected. Considering the fact that thrust of accusation is against the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
