JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report and some witnesses are said to have seen the petitioner and others carrying the victim but after recovery when the statement of victim was recorded under Section 164 of the Cr.P.C., she did not name the petitioner rather it is stated that the other accused kidnapped and committed rape with her.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Manoj Kumar, Judicial Magistrate-1st Class,
