The petitioner seeks bail in a criminal prosecution registered under Section 323, 420, 467, 468, 471 and 120B of the Indian Penal Code.

It is submitted that the informant is the mother of the present petitioner and because of squabbles between the petitioner and his sibling on account of land dispute, the present criminal case was lodged. However, subsequently, the matter has been amicably resolved and a compromise petition has been filed in the court below. The petitioner is said to be in judicial custody since 09.12.2014.

Taking into consideration the aforesaid submissions, particularly about the compromise between the parties, the prayer for bail of the petitioner in connection with Town P.S. Case No. 786 of 2014, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur is allowed, subject to verification by the learned court below about genuineness of the factum of compromise between the petitioner and his own mother, who is informant. If the informant appears before the learned court below

Patna High Court Cr.Misc. No.11161 of 2015 (2) dt.25-05-2015 2/2 and vouches about the genuineness of the compromise petition, then the petitioner shall be released on bail on furnishing bail bond of Rs.25,000/- (Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Town P.S. Case No. 786 of 2014.
