The petitioner is apprehending his arrest in connection with Sheosagar (Baddei O.P.) P.S.Case No.329 of 2018 registered for offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
Petitioners happen to be husband. Case is of dowry death and the allegation is of demand of one motorcycle as well as golden chain and it is alleged that for that she was set on fire. Submission of the learned counsel for the petitioner is that as a matter of fact she has committed suicide and the same was informed to the informant and the dead body was disposed of in front of them but now the present case has been lodged with ulterior motive.
Heard learned A.P.P. , who has opposed the prayer for bail
Patna High Court CR. MISC. No.4519 of 2020(2) dt.23-01-2020 2/2 on the ground that there is allegation against the petitioner. Having heard both sides and considering the above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.
With the aforesaid direction, this application is dismissed.
