This application is filed for grant of regular bail in connection with Sessions Trial No. 371 of 2019 arising out of Maharajganj P.S. Case No. 63 of 2019 registered under sections 302, 120(B)/34 of the Indian Penal Code.

The prosecution story in short is that the informant received information about the murder of her son who was living with Malti Devi (petitioner) and her daughter Kajal Kumari since two years. When she reached the spot she saw her son namely Chandan Kumar was killed by knife injury. The petitioner is suspected to have killed the

Patna High Court CR. MISC. No.2213 of 2023(3) dt.25-05-2023 2/2 deceased. She is facing trial. She is in custody since 14.03.2019. In the trial only two witness have been examined. The accused has also the right of speedy trial.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District and Sessions Judge, Siwan in connection with Sessions Trial No. 371 of 2019 arising out of Maharajganj P.S. Case No. 63 of 2019.

The petitioner is directed to cooperate in the trial and will not absent herself on the dates on which witnesses will appear for examination. She will appear either herself or through her lawyer.
