The petitioner is languishing in custody since 24.02.2015 in a case registered for the offences punishable under Sections 147, 149, 447, 341, 323, 324,307, 379 and 504 of the Indian Penal Code.
It is alleged that the petitioner assaulted with Farsa on the head of the informant and thereafter others assaulted the informant.
It is submitted by counsel for the petitioner that the accusation has been levelled in the background of land dispute. The injury report suggests one lacerated grievous injury on the scalp, but the said injury has been opined to be caused by
Patna High Court Cr.Misc. No.13061 of 2015 (02) dt.03-04-2015 2/2 hard and blunt substance.
Considering the fact that accusation is not being corroborated by the medical opinion and a statement has been made in para 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Bahadurpur P.S. Case No. 36 of 2015.
