Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of second anticipatory bail, arises out of Karandey PS case no. 16 of 2024, disclosing offences punishable under Sections 379, 411/34 of the Indian Penal Code and Section 25(1-b)a of Arms Act.

The first anticipatory bail application of the petitioner has been rejected on merit vide order dated 04.09.2024, passed in Cr. Misc. No. 56647 of 2024. He moved the second anticipatory bail application i.e. the present application on the ground that after rejection of his first bail application, co-accused Lalu Kumar has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 30.09.2024, passed in Cr. Misc. No. 60696 of 2024.
Patna High Court CR. MISC. No.7297 of 2025(2) dt.07-02-2025 2/2 However, the order of rejection of anticipatory bail, passed by this Court earlier in Cr. Misc. No. 56647 of 2024 dated 04.09.2024 was not brought to the notice of learned co-ordinate Bench.

In my opinion, the subsequent order, granting anticipatory bail to the co-accused cannot be considered as subsequent event for consideration of a second anticipatory bail application of the petitioner, whose anticipatory bail has already been rejected by this Court on merit.
