JUSTICE S. KUMAR ORAL ORDER 12-01-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners in both these applications seek regular bail in connection with Special Case No. 7 of 2012 arising out of Bhabua P.S.Case No. 533 of 2011 registered under Sections 409,

Patna High Court Cr.Misc. No.47635 of 2017 (5) dt.12-01-2018 2/3 420, 467, 468, 471/34 and 120-B of the Indian Penal Code and Section 13(1)(d) of the Prevention of Corruption Act. The FIR has been lodged on the basis of letters of the Civil Surgeon against one Dr. Uchit Lal Mandal. The name of the petitioners transpired during investigation after five years. Allegation against the petitioners is that their NGO received huge amount under different schemes of the Government without providing any service. It is also alleged that the petitioners' NGO is non-existent.

Learned counsel for the petitioners submitted that the allegations made against the petitioners are general and omnibus and the NGO of the petitioners is a registered NGO and has executed the work as per agreement. It is further stated that the charge-sheet has already been submitted in this case and as such there is no chance of tampering with the evidence. The petitioners are in custody since 28.08.2017 and they have no criminal antecedents.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Court Vigilance 1st, Patna, in

Patna High Court Cr.Misc. No.47635 of 2017 (5) dt.12-01-2018 3/3 connection with Special Case No. 7 of 2012 arising out of Bhabua P.S. Case No. 533 of 2011.
