JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report on the ground that there was land dispute between deceased and them and prior to the alleged occurrence, deceased had lodged a criminal case in which petitioners and co-accused Madhu Sudan Choudhary were sent to jail, but submission on behalf of the petitioners is that co-accused Madhu Sudan Choudhary had already been granted privilege of bail and moreover, none has seen the actual killing of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners above named be

Patna High Court Cr.Misc. No.2751 of 2016 (2) dt.30-01-2016 2/2 released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Simri P.S. Case No.104 of 2015.
