JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-03-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 420 and other allied sections of the IPC and sections 30a and 41(i) of the Bihar Prohibition and Excise Act.

As per the prosecution case, about 8641 liters of foreign liquor was recovered from the truck and two persons were arrested on the spot who disclosed that the petitioner had supplied the said liquor.

Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is neither the owner nor the driver of the vehicle in question. He is in

Learned counsel appearing for the State opposes the prayer for bail and submits that 10 criminal cases of similar nature are pending against the petitioner.

Considering the rival submissions of the parties and criminal antecedent of the petitioner, prayer for bail of the petitioner is refused.

However, the court in seisin of the matter shall release of the petitioner on bail to its own satisfaction as and when charge is framed in the case.
