JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Two ATM cards are said to have been recovered from conscious possession of the petitioner and police suspected that petitioner was an active member of a gang, whose modus operandi was to replace ATM cards of customers and to withdraw money from ATM.

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioner does not have any criminal antecedent and is languishing in jail custody since 10-11-2015, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.2583 of 2016 (3) dt.29-01-2016 2/2 amount each in connection with Motipur P.S. Case No. 309 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Muzaffarpur (West).
